The Andalucian Government has introduced increased tax rates on the taxes payable on the transfer of a property (impuesto sobre transmisiones patrimoniales). With effect from 1 January 2012 there are now 3 levels of tax payable on the transfer of a property as follows:
8% on the purchase price up to 400,000€
9% on the purchase price between 400,000€ and 700,000€
10% of the purchase price on any balance over 700,000€.
This tax includes stamp duty.
(Note these taxes do not apply to the first transfer of a new property when IVA will apply – see related article Your Property Purchase).
There are reductions in the rate where the purchaser is buying a home as a habitual residence, the value does not exceed 130,000€ and the person has a registered disability or is under 35 years of age.
There are further increases/changes to the tax rates payable on the transfer of garage places, and other assets.
